ACKNOWLEDGEMENT

These Terms and Conditions constitute a legally binding agreement made between you and Daniel Sosnovskij ("we," "us" or "our") concerning your access to and use of the RAWX mobile application (the “App”). By downloading and using the App, you verify that you have read, understood, and agree to be bound by these Terms.

You and we acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and the content thereof.

1. ELIGIBILITY & ACCOUNT

1.1. Age Requirement: You must be at least 18 years old to use RAWX.
1.2. Account Security: You are responsible for all activities under your account.
1.3. One Account Policy: Multi-accounting is prohibited.

2. APP FEATURES & FUNCTIONALITY

2.1. Swiping & Matching: Matches occur only upon mutual likes.
2.2. Location-Based Services: The App uses your geolocation to show relevant profiles.
2.3. AR Vision & Safety: Locations are obfuscated ("fuzzed") by a random offset for safety. Real-time precise tracking of other users is technically prevented.

3. APPLE MUSIC & MEDIA INTEGRATION

3.1. MusicKit: The App integrates with Apple Music to display your top songs or music preferences to potential matches.
3.2. Authorization: By connecting Apple Music, you grant the App read-only access to your music history and library.
3.3. No Modification: The App will not modify, delete, or change your Apple Music library data.
3.4. Subscription: A valid Apple Music subscription may be required for full playback functionality.

4. SUBSCRIPTIONS & PAYMENTS

4.1. Apple App Store: All purchases are processed securely via Apple's IAP system. The App does not store your payment information.
4.2. Finality of Sales: All purchases are final. Refunds are handled exclusively by Apple Support according to their policies.
4.3. Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period in Apple ID settings.
4.4. Management: Users may manage or turn off auto-renewal via their Apple ID settings.
4.5. No Cancellation During Active Period: The current subscription period cannot be canceled once active.

5. USER CONDUCT & CONTENT (ZERO TOLERANCE)

5.1. Prohibited Content: You may not generate content that is illegal, defamatory, pornographic, harassing, hateful, or otherwise objectionable.
5.2. Zero Tolerance: We have a ZERO TOLERANCE policy for objectionable content and abusive users.
5.3. Reporting & Blocking: You agree that you will report any user violating these rules via the in-app "Report" function. You can also block users immediately.
5.4. Action: We reserve the right to ban any user found violating these terms within 24 hours of a report.
5.5. Blocking & Reporting: Users may block or report other users at any time. All reports are reviewed manually within 24 hours.
5.6. Moderation & Enforcement: RAWX reserves the right to suspend or permanently remove accounts that violate these Terms, community guidelines, or applicable laws.

6. APPLE REQUIRED LEGAL PROVISIONS

6.1. Apple Disclaimer: You acknowledge that Apple has no obligation to furnish any maintenance or support services with respect to the App.
6.2. Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
6.3. Product Claims: RAWX, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal compliance, and consumer protection claims.
6.4. Intellectual Property Rights: In the event of any third-party claim that the App infringes IP rights, RAWX, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge.
6.5. Legal Compliance: You represent and warrant that you are not located in a US-embargoed country or listed on any US Government prohibited list.
6.6. Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms.

7. ACCOUNT TERMINATION & LEGAL HOLD

7.1. Account Termination: You may terminate your account at any time through the App settings. Upon termination, your public profile will be removed from the Service and will no longer be visible to other users.
7.2. Legal Hold Notice: You acknowledge that notwithstanding account deletion, RAWX reserves the right to retain specific account metadata, communication logs, and match history for a period of twelve (12) months in a secure, isolated archive. This retention is strictly limited to compliance with statutory data retention obligations (including French Law No. 2004-575 "LCEN") and for user safety.

1. INTRODUCTION

Welcome to RAWX. We respect your privacy and are committed to protecting your personal data, specifically regarding your Location and Media usage.

2. DATA WE COLLECT & PERMISSIONS

2.1. Location Data (CoreLocation & MapKit): We collect latitude/longitude when in use to power "Matches Nearby" and AR. Precise location is processed to generate a "fuzzed" (approximate) location before storage. We do NOT store movement history.
2.2. Apple Music Data (MusicKit): We access a token to fetch Top Songs/Playlists to improve matching. We store references (IDs), not audio files.
2.3. Camera & Photos: For profile creation, AR View, and Liveness Verification. AR processing occurs locally.
2.4. Phone Number: For account verification and fraud prevention. Stored securely.

3. FACE DATA & LIVENESS CHECK

We use facial geometry data solely for liveness verification to ensure the authenticity of user profiles. This data is processed locally and is not stored or transmitted.

4. BIOMETRIC DATA COMPLIANCE

We explicitly confirm that facial geometry data is collected solely for liveness verification, is never stored, never shared, never reused, and never used for identification or profiling. The data is processed once and immediately discarded.

5. HOW WE USE YOUR DATA

To provide the service and enforce our Terms of Service. We rely on Contractual Necessity and Consent.

6. THIRD-PARTY SHARING

We do not sell your data. We share data only with Apple Inc., Cloud Providers (AWS/Google), and Legal Authorities. We do not share data with advertising networks.

7. DATA RETENTION & DELETION

We retain data only as long as your account is active. Deletion removes profile and music preferences immediately.
7.1. Data Retention After Deletion: In compliance with applicable laws (e.g., LCEN), we retain certain technical/identification data (Phone, UUID, Logs) for 12 months in a secure archive for crime prevention.
7.2. Retention of Banned Account Data: If banned, we retain verified phone number and device identifiers for a minimum of 1 year to prevent re-registration.

8. YOUR RIGHTS (GDPR/CCPA)

You have the right to access, rectify, delete, or restrict processing of your data. Contact us at support@raw-dating.com.

9. SECURITY

We use industry-standard encryption (SSL) for all data in transit. In event of a breach, affected users will be notified.

10. CHILDREN'S PRIVACY

Strictly 18+. We do not knowingly collect data from minors.
