Terms and Conditions (T&C) – Beta Version

Scope: These T&C govern the use of the beta version of this mobile app (hereinafter "the App"). By downloading, registering, or otherwise accessing or using the App, the user ("you") fully and bindingly accepts these terms. If you do not agree to these terms, do not use the App.

1. User Eligibility and Registration
1.1. Minimum Age: Use of the App is strictly reserved for individuals who are at least 18 years of age. By registering, you confirm that you meet this requirement.
1.2. Accurate Information: You are solely responsible for the authenticity, accuracy, and completeness of all information you provide during registration and in your profile. Misrepresentation may lead to immediate account termination.
1.3. Single Account Policy: Each person is permitted to create only one account. The use of multiple accounts (multi-accounting) is strictly prohibited and will result in the permanent suspension of all associated accounts without notice.

2. Account Management, Premium Services, and Content
2.1. Account Deletion by User: You may permanently delete your account at any time via the App's settings, provided it is not currently suspended. Deletion is irreversible and will erase all personal data associated with your profile.
2.2. Content License: By uploading content (such as photos, text, etc.) to the App, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, and display that content in connection with operating and promoting the App.
2.3. Premium Services & Beta Notice: The App may offer paid "Premium" features. You expressly acknowledge that during this beta phase, Premium services may contain errors, be unstable, or function incorrectly. All purchases are final. Refunds for fees already paid are excluded, except where required by mandatory statutory provisions.
2.4. Right of Withdrawal for EU Consumers: If you reside in the EU, you generally have a 14-day right of withdrawal for digital services. However, you explicitly agree that this right is forfeited once you access or use the Premium features, as the performance of the service begins immediately with your consent.
2.5. Loss of Premium Status: Any existing Premium status and paid features expire immediately and without any claim for a refund if your account is deleted (by you) or suspended (by us) for violating these T&C.

3. Code of Conduct and Account Suspension (Bans)
3.1. Prohibited Actions: We reserve the right to suspend accounts at our sole discretion, without prior notice, for serious violations. Such violations include, but are not limited to:
- Creating fake profiles, impersonation, or providing false information.
- Abusive, harassing, threatening, or offensive behavior towards other users.
- Publishing illegal, pornographic, violent, discriminatory, or hateful content.
- Commercial solicitation, spamming, or engaging in fraudulent activities.
- Attempting to manipulate, hack, or disrupt the App's services.
3.2. Effect of Suspension: Upon suspension, your profile data will be irrevocably deleted. To enforce our terms and prevent re-registration, we will indefinitely retain the mobile number used for registration, the ban status, and the reason for the suspension. This data is processed in compliance with GDPR for the legitimate interest of platform security.

4. User Interactions, Meetings & Liability Disclaimer
4.1. User Responsibility: You are solely responsible for your interactions with other users. Meetings arranged via the App are undertaken exclusively at your own risk. The App Operator is not a party to any arrangement between users.
4.2. Safety Warning: We strongly advise you to exercise caution, use common sense, and arrange meetings only in safe, public places. We do not conduct criminal background checks on our users.
4.3. Full Limitation of Liability: To the fullest extent permitted by law, the App Operator assumes absolutely no liability for any direct, indirect, incidental, or consequential damages, including emotional distress, physical harm, or financial loss arising from your use of the App or from meetings with other users. The App is provided on an "as-is" and "as-available" basis.

5. Image Verification & Data Processing
To ensure platform integrity, profile photos are temporarily processed by an automated AI engine for compliance checks. These images are held for a maximum of 5 minutes before being irrevocably deleted. By using the App, you explicitly consent to this temporary, automated processing. 6. Beta Phase Disclaimer
You acknowledge that the App is a beta version and may contain bugs, errors, and other problems. We provide no guarantees regarding the App's availability, reliability, or functionality. We are not liable for any damages, including data loss, arising from the use of this beta software.

7. Final Provisions
7.1. Applicable Law: These T&C shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
7.2. Jurisdiction: For all disputes arising from this user agreement, the exclusive place of jurisdiction shall be Berlin, Germany, provided you are a merchant or have no general place of jurisdiction in Germany.
7.3. Amendments: We reserve the right to amend these T&C at any time. You will be notified of significant changes within the App. Your continued use of the App after such notification constitutes your acceptance of the amended terms.
7.4. Severability Clause: Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall not be affected.

Privacy Policy

1. What data we collect and why:
- Phone Number: For account verification and to prevent fraudulent accounts (authentication).
- Profile Information: Name, photos, and other details you provide are used to create your profile and enable matchmaking.
- Location Data: We use your approximate location to suggest nearby users and venues for dates.
- Usage Data: Information on how you interact with the app helps us to improve the service and fix bugs.

2. How we process and store data:
- All user data is processed and stored on secure servers located within the European Union (EU) to comply with GDPR standards.
- We use industry-standard encryption for data in transit and at rest.

3. Data Retention:
- Your personal data is retained as long as your account is active.
- Upon account deletion, your profile data is permanently erased from our primary systems within 30 days.
- Anonymized usage data may be retained for analytical purposes.
- In case of an account suspension (ban), your phone number is retained indefinitely to prevent re-registration, as stated in our T&C.

4. Third-Party Services:
We rely on trusted third-party services to operate RAW:
- Firebase (Google): Used for authentication, database hosting, and analytics.
- Amazon Web Services (AWS): Used for server infrastructure and data storage.
- AI Service for Image Moderation: We use an automated service to temporarily process images for safety checks, as detailed in our T&C.

5. Your Rights under GDPR:
You have the right to:
- Access: Request a copy of the personal data we hold about you.
- Rectification: Correct any inaccurate information in your profile.
- Erasure ("Right to be Forgotten"): Delete your account and associated personal data.
- Restrict Processing: Limit how we use your data in certain circumstances.
- Data Portability: Receive your data in a machine-readable format.
